BIDDING / BIDDING FROM ABROAD

Participant in the bidding should request in advance a

numbered bidding paddle from the registration desk.

Bids should be made with a loud voice or by clear signal,

such as indicating with the bidding paddle. Any person

bidding for another party will become liable as a debtor.

The auctioneer is entitled to settle any dispute over the

bidding.

If you would like to participate in our auction from

abroad please contact us for registration in advance

and no later than two hours before the auction

starts.

ABSENTEE BIDS

Blomqvist accepts absentee bids. This service is free

of charge. Written bids from bidder living outside of

Norway can be submitted two hours before the auction

starts at the latest. This can be done by mail to our

office or via internet at

www.blomqvist.no.

A bidding form can be found in the catalogue and is

also available at our office. Blomqvist treats absentee

bids confidentially and bids as favourably as possible on

behalf of the client. In the event of equal bids, the first

incoming bid will confer the right of purchase.

TELEPHONE BIDS

Blomqvist can arrange for clients to bid by telephone.

Bidders have to confirm by mail or letter before 4 PM

on the day of the auction. As telephone lines are limited

telephone bidders should have the intention to bid at

least up to 90% of the estimate.

ESTIMATE

The estimated price of a lot is based on a market

valuation of the lot made by Blomqvist. The estimate

acts only as a guide and the price at which the lot is sold

may vary from the estimate.

PAYMENT AND CHARGES

A premium of 25% on the hammer price is payable

for lots staying in Norway. For lots to be exported, the

premium is 21,2% plus 25% VAT for artwork

20% plus 25% VAT for other objects. The VAT will

be refunded (see EXPORT). Payment can be made

immediately after the hammer has fallen or made within

one week of the purchase. We accept major credit cards.

DROIT DE SUITE AND ARTIST FEE

The artist resale law (Droit de suite) covers the purchase

of art by living artists and is applicable up to 70 years

after the artist’s death. For more expensive artwork the

royalty is reduced as follows:

50.000,01-200.000 Euro: 3%,

200.000,01-350.000 Euro: 1%,

350.000,01-500.000 Euro: 0,5%

above 500.000 Euro: 0,25% and the maximum royalty

on any work is 12.500 Euro. For the lots in question the

invoice will be reduced accordingly.

70 years after the artist’s death there will be an art tax

fee of 5% on the sale price plus the premium.

COLLECTION

Please note that all lots bought at the auction not

collected or transport arranged for within 30 days after

the auction will be transported to an external warehouse

at the buyers expense. Special terms apply for buyers

outside of Norway.

CLAIMS

All lots are sold in the state and condition in which they

are found when sold. The catalogue is produced to the

best of Blomqvist’s knowledge. Should any doubt arise

about the genuineness of any lot, Blomqvist must be

informed immediately and in any event no later than 30

days after the auction. Given adequate proof that the

purchased lot is not according to the catalogue text, the

buyer is entitled to return the lot in the same condition

as sold against repayment of the purchase price. The

buyer is not entitled to receive any payment for cost

or loss of profit beyond repayment of the purchase

price. No warranty what so ever is given by Blomqvist’s

employees, its servants or agents to any buyer in respect

of any lot. Any expressed or implied conditions or

warranties are hereby excluded.

DEFECTS AND CONDITION

Defects and conditions are usually not indicated in the

catalogue. It should not be possible to claim cancellation

of a purchase in pursuit of the above provisions if:

a) The catalogue description on the day the lot was sold

to the buyer was in accordance with the then generally

accepted opinion of scholars and experts.

b) The only way of establishing whether the lot was a

forgery at the time of the publication of the catalogue

was the implementation of scientific process, the validity

of which was only acknowledged after the time, and

required a disproportionate amount of cost or would

have been impossible to carry out without damaging the

lot in question.

EXPORT

a) Exemption from the Norwegian VAT when exported

by a forwarding agent. Lots exported within one month

from the auction through a forwarding agent approved

by us are exempted from Norwegian VAT. Let us know

if you need more details.

The rules apply to a buyer with a permanent address

abroad who wishes to take a purchased lot along as

luggage. The lot must have been paid in full and the

Norwegian VAT of 25% must be deposited with us.

The VAT will be refunded as soon as we have

received the export papers with the official custom

clearance stamps.

b) Exemption from the Norwegian VAT when exported

by the buyer personally as luggage.

The following rules apply to a buyer with a permanent

address abroad who wishes to take his/hers purchased

lot along as luggage. The lot must have been paid in

full and the Norwegian VAT of 25% must be deposited

with us. The VAT will be refunded as soon as we have

received the export papers with the official custom

clearance stamps.

EXPORT LIMITATION

Please note that lots covered by the provisions of the

Cultural Heritage Act of 9th of June 1978, no. 50 with

changes latest 3rd of March 2000 no. 14, need a written

export permission before being exported. Blomqvist will

help with the application free of charge, but any charge

by the institutions will be added to the purchase price.

The exchange rate used in this catalogue is 1 Euro = 10

NOK. In our online catalogue the exchange rate will be

updated with the fluctuation in the market.
